General Terms and Conditions:
By attending or participating in an auction operated by Roadrunner Auctions, LLC, (hereafter referred to as Roadrunner Auctions), in any way or in any capacity, whether in person, online, absentee, or acting as an agent for a participant, you agree to abide by the terms and conditions set forth in this document.
All bidders must be registered with Roadrunner Auctions and be in possession of a valid bid card when participating in any live auction offered by Roadrunner Auctions. All bidders must have and be in possession of a valid state or federal ID card and be at least 18 years old the day of sale to participate as a bidder of any auction offered by Roadrunner Auctions. Your bid is a contract and is considered as an acceptance of these Conditions of Sale.
All items and/or property sold is offered ‘AS IS’ and ‘WHERE IS’ and without recourse, and neither the consignor(s) nor Roadrunner Auctions make any representations or warranties, expressed or implied with respect to age, condition, size, count, weight, style, authenticity, genuineness, attribution, origin, quality, quantity, value, material, period, culture, rarity, importance, provenance, exhibitions, literature or historical relevance, manufacturer or any other warranty on any property offered for sale. The absence of a condition statement does not imply that the lot offered is in good condition.
The photo captions, catalog, internal or external search engines, advertising and/or auctioneer’s statements, etc, are a courtesy provided by Roadrunner Auctions, and meant as a descriptive guide only. The bidder is cautioned to use the preview and/or photographs to examine all merchandise using his/her best judgment as to whether or not the photo captions, catalog, internal or external search engines, advertising and/or auctioneers statements, etc, are accurate.
Roadrunner Auctions reserves the right to withdraw, combine, or divide any lot at its sole discretion prior to the commencement of bidding.
Roadrunner Auctions and its consignor(s) make no warranty or representation, expressed or implied that the bidder will acquire any copyright or reproduction rights to any lot sold. Roadrunner Auctions reserves the right to reproduce any image of any consigned lot. Roadrunner Auctions is the exclusive owner of all images used on our website. Unauthorized reproduction will be prosecuted to the fullest extent of the law.
Roadrunner Auctions reserves the right to withdraw any lot at any time prior to the commencement of bidding for such lot.
The purchase price payable by highest in-house, absentee, online or telephone bidders shall be the sum of the final bid plus the buyer’s premium of 15% There will be a 5% discount of the buyer premium when paying with cash. State sales tax will be charged unless Roadrunner Auctions is in possession of your current tax identification number.
All highest bid purchase prices will be in U.S. dollars. We accept cash, checks (with proper identification and an approved bank letter of guarantee), Visa, MasterCard, Discover,American Express credit cards and Paypal. All live auction purchases must be made in-house, (except for internet bidders), and are due the Day of Sale. All local internet purchases must be made in house, and are due the following day of the sale. As a courtesy and with prior approval, Roadrunner Auctions may extend the payment deadline to telephone and absentee bidders.
Consignment fees are set by Roadrunner Auctions in advance, and consignors are encouraged to familiarize themselves with the fees and conditions offered by Roadrunner Auctions. Consignor are allowed to bid and will be subject to all premiums and consignor rates.
Consignors are responsible for arranging their own lots. Lots or lot components are expected to be in working condition, as well as clean and presentable. Any lot containing items found to be non-working or dirty, can be returned or disposed of at Roadrunner Auctions discretion. Roadrunner Auctions will provide lot arrangement or lot boxing for an additional fee that is set in advance and will be provided upon request.
Roadrunner Auctions reserves the right to reject any bid, as well as the right to refuse to acknowledge any bidder. The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of a dispute between bidders, the auctioneer has the final discretion to determine the successful bidder or to re-offer the lot in dispute to any point where a bid may have been acknowledged. If any dispute arises after the sale of any lot, Roadrunner Auctions sales records shall be conclusive.
No auction lot may be removed during a live auction sale until the full purchase price has been paid. All lots must be so paid and removed at the highest bidders expense the day of the sale. Online, Absentee and Phone highest bidders must arrange pick up of their purchases within 2 business days of the auction or they become subject to a storage fee of $10.00 per item, per day and without exception. Roadrunner Auctions will not be held responsible for loss or damage to items not picked up the day of the sale. If storage fees are equal to or greater than the purchase price at any point after the day of sale, the item then becomes the property of Roadrunner Auctions and may be disposed of as seen fit.
Roadrunner Auctions does not provide assistance in the removal of any lot purchased by the highest bidder, nor does Roadrunner Auctions provide any packing or shipping materials required for the safe or secure removal of any lot, except for sales made to internet bidders paying for Roadrunner Auctions shipping, if offered. Not all internet auctions offer shipping services by Roadrunner Auctions. If shipping is offered by Roadrunner Auctions, it is usually offered at USPS Flat Rate Box published rates.
If, for any cause, a purchased lot is found to be stolen, broken or lost prior to highest bidder pickup during the day of, or after the end of the day of sale, Roadrunner Auctions shall not be liable for any amount paid by the purchaser. It will be at Roadrunner Auction's discretion if any refund or partial refund will be allowed.
Employees of Roadrunner Auctions are not prohibited from bidding on lots. In the course of their employment it is possible that they may have access to information not available to the public.
All measurements and weights offered for any lot by Roadrunner Auctions are approximate and are made as a courtesy to bidders.
Roadrunner is not responsible for typographical errors in regard to any description of any lot offered for sale.
Roadrunner Auctions is not responsible for damage of glass covering paintings, drawings, and other works or frames regardless of cause.
Roadrunner Auctions will not guarantee the authenticity of any signature unless so stated at the time of auction.
